Whistleblowing
The company JESSENIA a.s., with registered office at Okruhová 1135/44, 155 00 Praha 5 - Stodůlky, ID No.: 26752051, registered in the Commercial Register maintained by the Municipal Court in Prague under file No. B 13621, with its registered office at Rehabilitation Hospital Beroun, Prof. Veselého 493, 266 56 Beroun (hereinafter referred to as the "Company"), in accordance with Act No. 171/2023 Coll, on the protection of whistleblowers, as amended (hereinafter referred to as "the Act"), has established an internal whistleblowing system for its employees. This system is used to report possible infringements within the scope of Section 2(1) of the Act.
What can be reported
The internal system is designed to report unfair practices that:
- have the characteristics of a criminal offence, or
- have the characteristics of an offence for which the law provides for a fine of at least CZK 100 000, or
- violate the Whistleblower Protection Act, or
- violate another legal regulation or a regulation of the European Union in the areas referred to in Section 2(1)(d) of the Act.
Who may submit a notification
Only persons who:
- perform dependent work for the company in an employment relationship,
- perform voluntary work, professional practice or an internship for the company,
- apply for employment or other cooperation with the company.
The Company will not accept notifications from persons who do not perform any of the activities listed in Section 9(3)(a), (e), (h) or (i) of the Act for the Company.
How to submit a notification
Notification shall be made on form F_RNB_365_Internal_Notification_System
- By email: whistleblowing@nember.cz;
- In writing: by letter to the company's business address (marked "Whistleblowing - do not open");
- In person: by prior arrangement with the relevant person, no later than 14 days from the date of the whistleblower's request;
- To the public authority competent to deal with the notified infringement under other legislation, both national and EU.
The competent person
The competent person is the natural person responsible for receiving and assessing the notification. He or she must be of good character, of legal age and fully competent.
Anonymous notifications
Anonymous notifications are not covered by the protection afforded by the law. The procedure under the Act applies only if the identity of the notifier is later established. An anonymous notification is one in which the notifier does not give his or her name or other identifying information.
How the notification will be handled
Competent person:
- no later than 7 days after receipt, acknowledge receipt of the notification in writing;
- assess the validity of the notification and inform the notifier in writing of the outcome within 30 days of receipt.
In justified cases, the time limit may be extended by up to 30 days, up to a maximum of twice, if the matter is factually or legally complex.
Protection of the whistleblower
The whistleblower shall be entitled to protection from any retaliatory measures, including the mere threat thereof. The competent person shall maintain strict confidentiality of the identity of the whistleblower and of other persons involved in the notification.
Knowingly false notification
A person who makes a knowingly false report:
- is not protected from retaliation;
- commits an offence punishable by a fine of up to CZK 50 000.
